John Barlow in Newberry Co South Carolina

From the articles I have read about the inhabitants of South Carolina, it is possible that the this Barlow family may have migrated from Ireland before the Revolutionary War, perhaps with Rev. William Martin and his five shiploads of Presbyterian settlers in 1772.
 
JOHN BARLOW, probably born in Ireland, and died c1803 in Newberry Co SC.  He married ELIZABETH JOHNSTON, daughter of John Johnston..

1787, at a court held in Newberry, letters of adm. were granted to JOHN BARLOW in right of his wife, ELIZABETH, ... Children: (1) WILLIAM 100 acres (2) my four daughters (not named) to have 51 pds 7 sh 7 p current SC money....  HOWEVER>>> I located this book at my local library this morning, and it appears that this is a transcription from the above entry, and the part about children has been added on, they are not listed in the book.  I am wondering if they are indeed in the will of John Johnstone, and are his own children, not John's. I was so very disappointed.

In consideration of the sum of £80 Sterling, three negroes children, Viz., one little Negro boy named Santa Croiz about 5 years old, one little Negro girl named Harriet with her future increase about a half year old, one little Negro child named Ireland about 3 months old.

In consideration of the sum of £1500 Sterling 400 acres of land in the County aforesaid between the forks of Mudlick Creek and Little River, originally granted to John Andrews and by Samuel Andrew, son of said John, sold and conveyed to JOHN BARLOW; also 12 Negroes, Viz., Negro man, named Wigdom, about 25 years old, one Negro man, named Tom, about 25 years old, one Negro man named Major, about 28 years old, one Negro man, named Jacob about 40 years old, one Negro man, named Bob, about 40 years old, one Negro boy, named Thomas, about 10 years old; two Negro wenches named Mary Ann and Susahan, Mary Ann about 50 years old and Susanah about 27 years old, together with Susanah's children one named Fortune, about 7 years old, one named Santa Croix, about 5 years old and one little girl, named Hariot, nigh 3 years old, one Negro child, named Ireland together with Susanah's future offspring...

February 27, 1795. Bill of Sale.
Whereas on the 27 February 1795 JOHN BARLOW of the State and County aforesaid convey to me Andrew Smith of the same place all his estate both real and personal; that is to say a tract of four hundred acres of land as therein mentioned as also 12 Negroes (Slaves) as therein mentioned as named Wigson, Tom, Major, Jacob, Bobb, Thomas, Mary Ann, Susanna, Forturne, St. Croix, Harriott and Ireland together with stills, horses, cattle, hoggs, plantation tools with the future offspring or increase of said Negroes and stock aforesaid together with all and every other article belonging to the said JOHN BARLOW for the consideration of £100 Sterling. Whereas I have not paid the said consideration or any part of the same to the said John Barlow except the land and four negroes namely Bob, Fortune, St. Croix and Harriott was conveyed to me in trust for use and benefit of him the said JOHN BARLOW whereas the said Barlow is desirous to have this property returned to him again. Now Know all Men by these presents that I Andrew Smyth for and in consideration of the four negroes as before excepted namely Bobb, Fortune, St. Croix and Harriott do exonerated, acquit and release and discharge the said John Barlow of and from all mortgages deeds obligation of Bill of Sale.

      These are to authorize and empower you, or any three or four of you, whose names are here underwritten, to repair to all such parts and places within this state, as you shall be directed unto by Elizabeth Barlow or William Farr [sic] ~ administrators – of the goods and chattels, rights and credits of John Barlow – late of the said district, deceased, whereforever any of the said goods and chattels are or do remain within the said parts and places, and which shall be shewn unto you by the said Elizabeth Barlow or William Fair ~ and their view and appraise all and every the said goods and chattels, being first duly sworn on the Holy Evangelist of Almighty God, to make a true and perfect inventory and appraisement thereof, and to cause the same to be returned under your hands, or any three or four of you, unto the said Samuel Lindsey Esquire –on or before the Sixteenth – day of January – now next ensuing.

          KNOW ALL MEN BY THESE PRESENTS, That we Elizabeth Barlow—William Fair—John Wilson - & Hugh Wilson are holden and firmly bound unto Samuel Lindsey Esquire – Esquire; ordinary for the district of Newberry -- in the full and just sum of Two thousand Pounds ----- lawful money of this state, to be paid to the said Samuel Lindsey Esquire – or his successors, ordinaries of this district, or their certain attorney or assigns.  To which payment well and truly to be made, we bind ourselves, and every of us, our and every of our heirs, executors, and administrators, for the whole, and in the whole, jointly and severally, firmly by these presents.  Sealed with out seals, and dated the Sixteenth – day of October – in the year of our Lord one thousand eight hundred and three

THE CONDITION OF THIS OBLIGATION IS SUCH, That if the within bounden administrators of all and singular the goods, chattels and credits of – John Barlow – deceased, do make, or cause to be made, a true and perfect inventory of all and singular the goods, chattels and credits of the said deceased, which have, or shall come to the hands, possession, or knowledge of them the said administrators or into the hands or possession of any other person or persons for them and the same so made, do exhibit, or cause to be exhibited into the ordinary’s office of this district, at or before the Sixteenth day of January – next ensuing.  And the same goods, chattels and credits, and all the other goods, chattels and credits of the said deceased at the time of his death, which at any time hereafter shall come to the hands or possession of the said Elizabeth Barlow & William Faer [sic] – administrators on the estate of John Barlow deceased – or into the hands and possession of any other person or persons for them do well truly administer according to law.  And further, do make, or cause to be made, a true and just account of this administration, at or before the Sixteenth – day of January – next.  And all the rest and residue of the said goods, chattels and credits which shall be found remaining on the said administrators account (the same being first examined and allowed of by the ordinary of this district for the time being) shall deliver and pay unto such person or persons respectively as the said ordinary, by his decree or sentence, pursuant to the true intent and meaning of the statutes and acts of assembly, of force in this state, for the better settling of intestates’ estates, shall limit and appoint.  And if it shall hereafter appear, that any last will and testament was made by the said deceased, and the executor or executors therein named do exhibit the same to the said ordinary, making request to have it allowed and approved accordingly, if the said Elisabeth [sic] Barlow & William Farr [sic] – administrators on the estate of  Jn. Barlow aforesaid deceased – within bounden, being there unto required, do render and deliver the said letters of administration, approbation of such testament being first had and made, to the said ordinary; then this obligation to be void and of none effect, or else to remain in full force and virtue.

This apparently is the second John Barlow shown in the 1800 census, perhaps, Jr.
A marriage record found in South Carolina shows: John Barlow of Newberry District, and wife ANN SMITH, widow, 08 April 1808; William Shaw of Pendleton Dst., trustee; John Lee, John Dench, wit. [Marr set 5, 394-396]  I am unsure if this is the same John that had previously been married to Elizabeth or not ... as there are 2 John Barlow's in the 1800 census of Newberry Co.    Ann Smith was previously married, and I wonder if she might be the Elizabeth Ann Smyth / Smith, wife of Andrew Smyth / Smith, Jr. shown in the following deeds.  Ann's maiden name was Shaw, as shown on her tombstone: Mrs. Ann Barlow, daughter of Dr. James Shaw of Whitehaven, England, who departed this life at the home of her son William Smith in Clarkesville 7th March 1843 aged 86 years.  She is buried in the Old Clarkesville Cemetery, Clarkesville, Habersham Co Georgia.   Tombstone Photo by Find-a-grave
 
Equity cases, argued and determined in the Court of appeals of ...: Volume 1 - Page 587
South Carolina. Court of Appeals, Robert H. Speers - 1844 - 676 pages -          Watson, trustee, vs. Pitts, was decided by the Court of Appeals, at this place, in May, 1831, and is reported in 2d McMull. R. 298. By the marriage settlement of John Barlow, certain slaves were conveyed to the trustee, "to the use of, and in trust, nevertheless, for the sole use, benefit and behoof of the said Ann, (wife of John Barlow,) from this date, for and during the term of her natural life." No disposition of the property was made after the termination of Mrs. Barlow's life estate. The opinion of the court was delivered by Mr. Justice Johnson. "According to the legal effect of the deed," says he, "the property is" in the trustee, "until her death, (for the statute for transferring uses into possession, is limited to real estate,) and it is necessary that the legal property should abide in him to enable him to fulfil the trust declared in the deed. A conveyance in trust was necessary to obviate the marital rights of the husband, which would have arisen out of a direct conveyance to herself, and as long as she lives, the same necessity will exist, as she may again take husband." "Whether, therefore," says the Judge, "we consider the rights of the trustee, in reference to the legal effect of the deed, or the trusts to be executed under it, the legal estate must abide in him." The case of Whitfield Jones and Lambert Jones vs. John B. Cole, was decided at the same court. Mrs. Jones, the mother of the plaintiffs, had conveyed certain negroes to a trustee, "in trust for her separate and exclusive use and behoof, during her natural life, and, after her death, to the use of the plaintiffs, or the survivor of them, and their heirs forever, share and share alike." Mrs. Jones afterwards died, and this action was instituted. "This deed," says Judge Johnson, delivering the opinion of the court, "like all others, must be so construed that it may take effect according to the intention (o be collected from the deed itself. The donor, as recited in the deed, was about to be married to a second husband, and being desirous to secure her property to her own separate use during her life, and to her children by her former marriage, after her death, conveyed the negroes to the trustee," <fec. After commenting further on the deed, and stating the duties of the trustee, he continues, "the right of possession, as well as the right of property, accrued, therefore, to the plaintiffs, on the instant of the death of the donor. According to the terms of the trust, no act was necessary on the part of the trustee, to invest the cestui que trust with the right of property, not even a conveyance, for personal estate passed without it." Without any reference to the statute of Uses, it was held that the plaintiffs were well entitled to maintain the action. These decisions are in entire accordance with the English authorities, and the then well understood law of South Carolina. Neither the statute of Uses, nor the 10th sec. of the statute of Frauds, embrace personal property. "The very silence of the statute," as is said in Scott vs. Scholey, "which introduces a new provision as to lands and tenements held in trust, but says nothing as to trusts of chattel interests, affords a strong argument that these interests were meant to continue in the same situation and plight in which both freehold and leasehold trust interests equally stood prior to the passing of those statutes." All the legal estate is vested in the trustee, for legal purposes. If the deed be not bona fide, it may be impeached for fraud, either at common law, or by the statute of Elizabeth. If the instrument be a marriage settlement, and is not recorded, so as to prevent misconception from the ostensible ownership of the cestui que use, it becomes obnoxious to the provisions of our own statutes. But so long as the trust subsists, any equitable interest of the cestui que t7-ust can be reached only through the appropriate tribunals, unless the deed itself violates some principle of law, or wants some of the formalities prescribed by law.

William Kerr & Esther his wife vs. James Boyd & others
March 1820
John Barlow died intestate with 2 tracts of land, one containing 194 acres and the other adjoining and containing 151 acres. He was survived by a widow Elizabeth Barlow and a child Peggy Barlow. Peggy later married Archibald Boyd. Peggy died shortly after intestate leaving her husband and a child James Boyd. Archibald then married Esther. Archibald Boyd died intestate in August 1816 with a tract of land containing 430 acres bound by lands of William Bridges, John Tidmore, Stephen Bowers, James Young, and others. He was survived by a widow Esther Boyd and children James Boyd (child by 1st wife), Eliza Boyd, Sarah Boyd, Molly Boyd, Alfred Boyd, and Joseph Young Boyd. Esther later married William Kerr. The tracts of land to be sold on the 1st Monday in December 1820. (Box 1, Folder A-17)
 
Information at Find-a-Grave.com submitted by Casey Elizabeth Kendrick shows that Elizabeth and John are buried in the Pitts Graveyard, Chappel, Newberry Co SC, but no dates or proof is given.  Also found at that site is the grave of Elizabeth A. Pitts, who is said to be the daughter of John and Elizabeth Barlow.  Her dates are 1780 - 1818, her husband being Edward A. Pitts, June 1769 - September 1837
 
If the previous 2 entries are correct, it would appear that John and Elizabeth had at least 2 daughters:
2 i. MARGARET 'PEGGY' BARLOW, born _____ and died after 1814.
3 ii. ELIZABETH ANN BARLOW, born 14 June 1780, and died 22 July 1816, burial in Pitts Cemetery, Chappel, Newberry Co South Carolina

She married EDWARD A. PITTS

Daniel Pitts (ca.1730-1806), said to be a son of Joseph and Nancy (Slaughter) Pitts, came to Newberry with his brothers Henry and William before the Revolutionary War. He was granted 150 acres in Newberry on March 24, 1756. He also had land in Edgefield County (Edgefield Co. Abstracts of Deeds, Vol. 1).
He married about 1756 Jane (P.?)and his will was probated April 6, 1806 (Newberry Co, S.C. Loose Wills, vol. 2, p.17) Both are buried in their small family cemetery seven and 1/2 miles north of Chappells. Their children were:
1. Daniel Pitts, Jr. (b.1758); will probated May 30, 1804; married Annah and had issue: Larkin, Joseph, Daniel, Jesse, and Mrs. James Sterling.
2. David Pitts (ca 1760-1807) married Christian Waldrup.
3. Thomas (1762-1828) married Nancy Waldrop. son Elijah Pitts (1793-1886) married his second-cousin's daughter, Amy Pitts (see: Nathan Pitts Family)
4. Winneford (died by 1806) married 1st Mr. Pitts (cousin) and had son Wm. Pitts; married 2nd Mr. Johnson and had 4 children.
5. Susannah (member of Bush River Bapt. Church) married 1st Mr. Wyatt (had son Isham); married 2nd Reuben Lasonbey (Listenby; Listenberry)
6. Melinda married Henry Weaver.
7. Sarah married Olleyman Dudgeon, first-cousin of Martha Caldwell (Mrs. Patrick) Calhoun, mother of John C. Calhoun.
8. John (died by 1806)
9. Jesse married Sarah and lived in Edgefield in 1791.
10. Edward (4 June 1769-4 Sept 1837 married 1st Elizabeth Barlow (1780-1818); daughter of John and Elizabeth Barlow; he married 2nd, widow of E.A. Smith. Edward and family lived on his parents' plantation and are buried in their family cemetery. Edward and Elizabeth had two daus, Rebecca B. married Silas Hill and Mary Y. married James C. Vaughn. --------------------------
This is copied as given. There is much Pitts info in this large book. I cannot vouch for the correctness of the data given, but so far I have not found the data to be incorrect. I hope this will be helpful to those of you trying to pin down your Daniel. There is a note under the data of a DAVID Pitts that states See: "PITTS FAMILY" (1950) by Leonardo Andrea Pitts Volumes, Eckhardt Collection, Clayton Library, Houston. Perhaps those of you in Houston would share data from there. I am only about 20 miles from the area where they originally lived and where Daniel is buried. Online records show a Barlow / Bonds / Lowery Cemetery on Indian Creek off #371 in Newberry Co SC, however, I was unable to locate any transcriptions or burial data from there.
