In County Court of Atchison County, Missouri, February term. Among the records of said court, made on the 16th day of February, A.D. 1869, is the following, to wit:

In the matter of the estate of Jeremiah Barlow, deceased.


Now here at this day comes Malcom McKillop, administrator of the estate of Jeremiah Barlow, deceased, and files a petition and stating among other things that the personal estate of said deceased are insufficient to pay the debts of the same, and praying of an order for the sale of the whole of the real estate of said deceased, or so much thereof as will be sufficient to pay the debts of said estate.

Accompanying said petition are the accounts, lists and inventories, required by law upon examination whereof.

It is ordered that all persons interested in said estate be notified of the filing of said petition; that unless they be or appear in this court, at the next term thereof, to be begun and held at the Court House, in the town of Rock Port in said county, on the 16th of August A.D. 1869, and show good cause to the contrary, an order will be made for the sale of the whole or so much of the following described real estate as will be sufficient for the purposes aforesaid, situated lying and being in the county of Atchison and state of Missouri, to wit:

All of the south-east fourth of the northwest quarter of section number twenty-three (23) in township number sixty-five (65) of range number forty-one (41) except what lies north of Schubert Branch containing twenty-five (25) acres, more or less. The west half of the south-east quarter of section number twenty-two (22) of township number sixty-five (65) of range number forty one (41), except as follows; Six acres known as belonging to T.J. Jones; also seven acres and thirty four and one-half (34 1/2) poles, described as follows: beginning at a stone, from which a white elm, hollow at the butt, thirty-six (36)inches in diameter, bears north eighty-seven and three fourths (87 3/4) degrees west sixteen (16) links,and a white elm fifteen (15) inches in diameter, bears forth eighty-two and one-fourth (82 1/4) degrees east eighty-nine (89) links thence north one (1) degree west twenty-one (21) poles and ten (10) links, to a stone, thence forty-eight and one-half (48 1/2) north of west thirty-eight (38) poles to a stone on the west side of Rock Creek, thence twenty-one and three-fourths (21 3/4) degrees west down said creek twenty-two (22) poles to a stone, thence down the same south thirty-three (33) degrees west forty-two (42) poles to a stone, thence north forty-nine (49) degrees, east sixteen (16) poles to the beginning. Also five (5) acres described as follows: commencing at the south-east corner of the south-west fourth of the south-east quarter of said section number twenty-five (25) in township number sixty-five (65) of range number forty-one (41), thence north ten (10) rods, thence west eighty (80) rods, thence south ten (10) rods, thence east eighty (80) rods to the beginning. Also the following: commencing at a point fourteen (14) chains and twelve (12) links south of the north-west corner of the south-east quarter of section number twenty-two (22) in township of number sixty-five (65) of range number forty-one (41), and at a point five (5) chains and eighty-nine (89) links west of a stone on the west bank of Rock creek at a stone thence south three (3) chains to a stone, thence south forty-four (44) degrees east to a stone five (5) chains and fifty (50) links, thence south six (6) chains and seventy-four (74) links to a stone on the west bank of Rock creek, thence northerly along Rock creek to a stone five (5) chains and eighty-nine (89) links east of a point of the beginning.


Also the following described tract: commencing at the north-west corner of the south-east quarter of section number twenty-two (22) of township number sixty-five (65) of range number forty-one (41), thence east thirteen and one-seventh (13 1/7) rods, thence north seventy (70) rods to the place of beginning, containing five and three-fourths acres.

It is further ordered that a copy thereof be published according to law in the ATCHISON COUNTY JOURNAL, a newspaper published in Athison county, Missouri.
